1. Scope
The following General Terms and Conditions (GTC) apply to all orders and contracts placed through our online shop. These GTC apply to consumers within the meaning of Section 13 of the German Civil Code (BGB).

3. Conclusion of contract
The presentation of products in the online shop does not constitute a legally binding offer, but rather an invitation to submit an offer. By submitting your order, you submit a binding offer to conclude a purchase contract. You will receive a confirmation of your order via email, but this does not constitute acceptance of the offer. The purchase contract is only concluded when we confirm your order by separate email or ship the goods to you.

4. Prices and shipping costs
All prices in the online shop include VAT. In addition to the stated prices, shipping costs may apply, which vary depending on the shipping method and delivery address. The shipping costs will be displayed before completing your order.

5. Payment
Payment is made using the payment methods offered during the ordering process (e.g., credit card, PayPal, instant bank transfer). Payment terms may vary depending on the payment method. For further information on payment methods, please refer to the relevant page in the shop.

6. Delivery
Delivery takes place within Germany and, where applicable, to other EU countries. The estimated delivery time is indicated during the ordering process and begins after successful order and receipt of payment. Delivery times may vary depending on the product and availability. If an item is not available, we will notify you immediately and, if necessary, cancel the delivery.

7. Custom-made products and exclusion of returns
Some products in our shop may be custom-made or personalized. These products are manufactured according to your individual specifications and are therefore excluded from the right of withdrawal. Returns or exchanges of custom-made or personalized products are therefore not possible unless the item is defective or has a manufacturing error.
Please note that the decision to purchase custom-made or personalized products is binding, as they will be made specifically for you after you place your order.

8. Right of withdrawal
Consumers have a right of withdrawal in accordance with statutory provisions. They may withdraw from the purchase contract within 14 days of receipt of the goods without giving any reason, unless the goods are custom-made or personalized, for which the right of withdrawal is excluded according to Section 312g Paragraph 2 of the German Civil Code (BGB).
To exercise your right of withdrawal, you must inform us (Bow Bow Cheer Shop, Zuzanna Badziong, Wolbecker Straße 87, 48155 Münster, Germany, email: hello@bowbowcheershop.com ) of your decision to withdraw from the contract by means of a clear statement (e.g. a letter sent by post or email).

In the event of cancellation, we will reimburse you all payments received from you, including delivery costs (except for additional costs resulting from your choice of a type of delivery other than the standard delivery offered by us), without undue delay and at the latest within 14 days from the day on which we are informed about your decision to cancel the contract.

9. Warranty and liability for defects
The statutory warranty rights apply. If a product delivered by us is defective, you can either request subsequent performance (repair or replacement). If subsequent performance fails, you can withdraw from the contract or reduce the purchase price.

10. Liability
We are only liable for damages resulting from intentional or grossly negligent breaches of duty. We are only liable for minor negligence if a material contractual obligation (cardinal obligation) has been breached. In any case, our liability is limited to the foreseeable damage typical for the contract.

11. Data protection
Your personal data is collected and processed in accordance with our privacy policy, which can be viewed on our website.

12. Retention of title
The goods remain our property until full payment has been made.

13. Dispute resolution
The European Commission provides a platform for online dispute resolution (ODR platform), which you can access at https://ec.europa.eu/consumers/odr . We are neither willing nor obligated to participate in dispute resolution proceedings before a consumer arbitration board.

14. Final provisions
The laws of the Federal Republic of Germany apply. The contractual language is German. Should individual provisions of these Terms and Conditions be invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
